as a result of European Union (EU) legislation certain agents are given special indemnity or compensation when the contract is terminated. Heretofore, in the UK at least, there would have been no liability. The Regulations apply to agents trading as individuals, partnerships or companies. They cover selling agents and buying agents. However, they apply to agents for the sale or purchase of goods, not services. In Scotland, compensation was awarded in one case by a capital sum representing two years' commission following French law and in an English case those who marketed gas as self-employed intermediaries were held to be entitled to the protection of the legislation; they were not ‘secondary agents’, who are excluded from protection.
