Will bankruptcy discharge judgment?

Ask a Lawyer

Question

Country: United States of America
State: CaliforniaI am scheduled to go to trial in February. The party I am prosecuting owes me at least $150,000.00. But, I am afraid that if I win, he will declare bankruptcy and I will never see my money. But, I know for a fact that he owns a house worth at least $600,000. What is the process like when this occurs and what are the chances of getting the money that would be owed to me?

Answer

It unfortunately can be discharged in bankruptcy unless it is for a wilful tort in some cases. You may have to just put other pressure on them if that happens...public pressure etc.
