periodical allowance periodical allowance in Scots family law, the award made to a spouse when a marriage is terminated by divorce or nullity. It should not be made unless a capital sum would be inappropriate. It stops when the party to whom it is awarded dies or is remarried. The hope of the Family Law (Scotland) Act 1985 was to provide a ‘clean break’, so periodical allowance should be out of the ordinary. This is, of course, not to be confused with aliment payable to a former spouse in name of children of the marriage. See PERIODIC PAYMENT ORDER. |
