Maternity allowance is a social security benefit if she cannot get statutory maternity pay. The particular rules vary from time to time. The essential protections involve allowing the woman who has worked close to the date of the pregnancy to be kept on after her pregnancy so long as she gives her employer notice before she stops working that she intends to return to work. If not allowed to return, the case will proceed much like one for UNFAIR DISMISSAL. Pregnant women in the UK have a right to a minimum of 18 weeks' maternity leave, and any dismissal of a female employee on the grounds of pregnancy constitutes UNFAIR DISMISSAL. Pregnant women also have the right to their usual employment benefits during these 18 weeks such as continuing use of their company car. These rights, based on a directive of the European Union, extend previous law on maternity rights which required minimum periods of employment.
