A leasehold interest that is terminable at the expiration of any given month,although state consumer protection statutes may require the landlord,the tenant,or both to give one month's notice before termination. Oral leases are assumed to be month-to-month, because the tenant pays rent one month at a time.If a tenant remains in possession of property at the expiration of a typical 6-month or 1-,3- or 5-year lease,courts in the various states are divided in their opinions regarding whether the new arrangement is a month-to-month tenancy or a renewal for a like term as the original lease,not exceeding 1 year.
