legitim (ˈlɛdʒɪtɪm) n (Law) Scots law the part of a person's moveable estate that is inherited by his or her children on that person's deathlegitim
legitim in Scots succession law, the bairn's part- that part of the legal rights in a person's moveable estate that cannot be disposed of by will. The fund amounts to one third if the spouse still lives, one half if not. The children of deceased children can represent their ancestor. Advances paid to an offspring can sometimes be treated as advances of legitim. As a result, other issue are allowed to have this notionally repaid to the fund before allocation of what is now in the fund - this is called collatio inter liberos. Similar legal institutions exist in other systems, for example, Jersey and Guernsey. |
