Designating or relating to an order ruling that, after a divorce, the former matrimonial home should not be sold until the divorcees' children have attained a certain age (usually 18) or completed their education. ΚΠ 1975 All Eng. Law Rep. 2 23 Counsel for the husband contended that this is a case which should fall into the Mesher category. I do not think it does. 1986 M. Berlins Law & You (1988) 75/1 The usual court order (lawyers call it a ‘Mesher’ order, after the names of the parties to the Court of Appeal case in which the first one was made) will be for the house to be kept until all the children have ceased their full-time education. 1992 R. H. Smith & C. R. Newton Jackson's Matrimonial Finance & Taxation (ed. 5) ix. 283 In Mesher v Mesher itself the house was in joint names and the interests were not disturbed. However, the expression ‘a Mesher order’ is commonly used in respect of any order where one of the events triggering a sale is the attainment of a specified age by the youngest child of the family.
